These Terms of Service (the "Terms") form a binding agreement between you and the operator of Olen ("Olen", the "App", "we", "us", "our"), and govern your use of the Olen mobile application.

1. About Olen
Olen is a paddling companion app for stand up paddleboard, kayak, and surf-ski enthusiasts. It lets you log paddle sessions, review statistics, catalogue your gear, explore water spots, read paddling guides, publish posts, comment, and message other paddlers. Sessions are started using Coins, an in-app virtual currency.
We may add, change, or discontinue features at any time.
2. Eligibility
You may use Olen only if you are at least 18 years of age, have the legal capacity to enter a binding contract, are not barred from use by applicable law or sanctions, and have not previously had an account terminated by us for a violation of these Terms.
You must confirm your age at first launch. A false age confirmation is a breach of these Terms and grounds for immediate termination.
3. Your Account
Olen supports Sign in with Apple. You are responsible for the security of the Apple ID and device used to access your account, and for all activity under your account. Notify us at service@olen.cloud if you suspect unauthorised access.
Each person may hold one account. Creating additional accounts to evade a suspension or otherwise circumvent these Terms is prohibited.
You may delete your account at any time from Me → Settings → Delete Account. Deletion is permanent: your content, statistics, gear entries, and any unused Coins are lost and cannot be restored.
4. Safety on the Water
- Distance, duration, speed, pace, and calorie figures are estimates and must never be relied on for navigation, rescue, medical, or competitive purposes.
- Guide articles are general educational information only, not a substitute for professional instruction, an official forecast, or local authority guidance.
- Water spot listings and community posts reflect user opinion. Conditions change.
- The App is not an emergency communication tool and is not a substitute for a leash, a flotation device, or a float plan.
- You are solely responsible for assessing your fitness, checking forecasts and tides, wearing appropriate safety equipment, complying with local regulations, and deciding whether to go out. Consult a physician before beginning or intensifying physical activity.
You assume all risk arising from your paddling activity. To the maximum extent permitted by law, we disclaim liability for injury, illness, death, property damage, or loss arising from your use of, or reliance on, the App.
5. Coins and Purchases
Coins are a virtual item with no monetary value, licensed to you for use inside Olen only. They are purchased through the Apple App Store or Google Play, whose prices, taxes, and receipts apply; we do not process payments. Starting a paddle session consumes a fixed number of Coins, shown in the App before use. We may adjust pricing and consumption rates prospectively, never for a completed transaction.
Except where required by consumer protection law, all Coin purchases are final and non-refundable. Coins cannot be exchanged for cash, transferred, gifted, or traded, and are forfeited without compensation if your account is suspended, terminated, or deleted. Refund requests permitted by platform policy must go to Apple or Google directly.
Coins unlock a functional feature only. There is no loot box, wager, randomised reward, or opportunity to win anything of real world value.
6. Acceptable Use
You agree not to:
- Publish content prohibited under Section 7.
- Harass, threaten, stalk, impersonate, or intimidate anyone, or contact a user who has blocked you.
- Scrape, harvest, or index users or content by automated means.
- Reverse engineer or attempt to derive the source code of the App, except where that restriction is unlawful.
- Interfere with, disrupt, overload, or attempt to gain unauthorised access to the App or related systems.
- Falsify paddle session data or misrepresent activity.
- Use bots, emulators, or modified clients to obtain Coins without payment or bypass Coin consumption.
- Use the App for commercial solicitation, advertising, or fundraising without our written consent.
- Upload malware or anything designed to damage a device or system.
- Circumvent moderation decisions, reporting mechanisms, or age gating.
- Use the App in violation of any law, regulation, or third party right.
7. User Content
7.1 Ownership and Licence
You keep ownership of the posts, photos, videos, comments, gear entries, and messages you create ("User Content"). By publishing it in Olen, you grant us a worldwide, non-exclusive, royalty free, transferable, sublicensable licence to host, store, cache, reproduce, reformat, and display it for the purpose of operating, improving, and promoting the App within its own surfaces, and you grant other users a licence to view your public content in the App. The licence ends when you delete the content or your account, subject to reasonable backup retention and copies preserved for legal or safety reasons.
7.2 Your Warranties
You represent that you hold all rights necessary to grant that licence, that the content infringes no copyright, trademark, privacy, or publicity right, that you have consent from any identifiable person appearing in it, and that it complies with these Terms and applicable law.
7.3 Prohibited Content
- Any content involving the sexual abuse or exploitation of minors, including CSAM, sexualised depictions of minors in any medium including AI generated imagery, grooming, sextortion, or the solicitation or facilitation of such material. See Section 8.
- Sexually explicit, pornographic, or gratuitously violent material.
- Hate speech, or content attacking a person or group on the basis of a protected characteristic.
- Harassment, bullying, threats, or incitement to violence.
- Promotion of self harm, suicide, eating disorders, or dangerous water challenges.
- Illegal activity, including drug sales, weapons trafficking, or wildlife crime.
- Another person's private information published without consent.
- Spam, deceptive schemes, engagement farming, impersonation, or manipulated media presented as genuine.
- Material infringing intellectual property rights.
7.4 Our Rights over Content
We are not obliged to pre-screen User Content, but we may review, refuse, remove, restrict, or age-gate any content, with or without notice, when we believe it violates these Terms or creates risk. Removal does not entitle you to a refund.
8. Child Safety and CSAE Zero Tolerance
Olen is an adults-only service and operates a zero tolerance policy toward child sexual abuse and exploitation (CSAE).
- Any content, message, or conduct that sexualises, exploits, or endangers a minor is prohibited without exception, whether real, illustrated, animated, or artificially generated. Grooming, sextortion, solicitation of minors, and the advertising, linking, or trading of CSAE material are prohibited.
- Every post, comment, chat, and profile carries a report control, and CSAE reports are prioritised above all other moderation queues. You may also report directly to service@olen.cloud with the subject line "CSAE Report".
- On credible report or detection we remove the content, permanently terminate the account, forfeit any Coin balance, preserve the evidence in restricted storage, and report to the National Center for Missing and Exploited Children (NCMEC) and other competent authorities as required or permitted by law.
- Terminated CSAE accounts are not eligible for reinstatement, and we take reasonable measures to prevent re-registration. We protect the identity of good faith reporters to the extent the law allows.

9. Reporting, Blocking, and Enforcement
Report any post, comment, message, or profile you believe violates these Terms. Block any user to hide their content and stop them messaging you (Me → Settings → Blocked Users).
Depending on the severity, frequency, and context of a violation, we may issue a warning, remove or restrict content, limit features, suspend the account, terminate it permanently with forfeiture of any Coin balance, or refer the matter to law enforcement. We aim to act on reports within 48 hours, and faster where child safety or imminent harm is involved.
Except in CSAE cases, you may contest an enforcement decision by emailing service@olen.cloud with the subject line "Enforcement Appeal" within 30 days, including your username and the action being contested.
Knowingly false, malicious, or mass reporting is itself a violation of these Terms.
10. Intellectual Property
The App, including its software, design, illustrations, iconography, guide articles, editorial content, brand names, and logos, is owned by us or our licensors. We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to install and use one copy of the App on a device you own, for your own non-commercial use, for as long as you comply with these Terms. You may not copy, modify, distribute, sell, lease, or create derivative works from the App.
Copyright complaints: email service@olen.cloud identifying the work, the infringing material and its location in the App, your contact details, a good faith statement that the use is unauthorised, a statement that the notice is accurate, and your signature. We remove infringing material promptly and terminate repeat infringers.
11. Third Party Services
Olen relies on Apple and Google for authentication, distribution, and payment processing, and may link to external resources such as weather or water authority pages. Those services are governed by their own terms and privacy policies, and we are not responsible for them.
Apple-specific acknowledgement: These Terms are between you and us, not Apple. Apple has no obligation to provide maintenance or support for the App and is not responsible for any product warranty, product liability, intellectual property, or consumer protection claim relating to the App. Apple and its subsidiaries are third party beneficiaries of these Terms.
12. Service Availability and Disclaimer of Warranties
The App is provided "as is" and "as available", without warranty of any kind, express, implied, or statutory, including merchantability, fitness for a particular purpose, title, accuracy, and non-infringement. We do not guarantee uninterrupted availability, that the App will be error free or secure, that estimates will be accurate, or that content contributed by other users is truthful, lawful, or safe to rely upon. We may suspend the service for maintenance, updates, or security response, and may change or remove features, with reasonable advance notice where a change is material and adverse.
You are responsible for your own device, operating system, storage, network connectivity, and any carrier data charges.
Some jurisdictions do not allow the exclusion of certain warranties; there, these exclusions apply only to the extent permitted.
13. Limitation of Liability
To the maximum extent permitted by law:
- We are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or opportunity.
- Our total aggregate liability for all claims relating to the App is limited to the greater of the amount you paid for Coins in the 12 months preceding the claim, or USD 50.
- We are not liable for the acts or omissions of other users, including conduct that occurs when users meet offline.
Nothing here excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence or for fraud. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
14. Indemnification
You agree to indemnify and hold harmless Olen and its operators, officers, employees, and agents from any claim, loss, liability, damage, or expense, including reasonable legal fees, arising out of your User Content, your use or misuse of the App, your violation of these Terms or of any law, your infringement of a third party right, or your paddling activity or interaction with another user.
15. Termination
You may delete your account at any time from Me → Settings → Delete Account. Uninstalling alone does not delete server-side data.
We may suspend or terminate your access, with or without notice, if you breach these Terms, if your conduct creates legal risk or harm to others, if required by law, or if we discontinue the service.
On termination your licence to use the App ends immediately, your access to your content in the App ceases, and any unused Coins are forfeited without compensation. Sections that by their nature should survive, including Sections 4, 7.1, 10, and 12 to 16, survive termination.
16. Governing Law and Disputes
Before starting any formal proceeding, contact us at service@olen.cloud describing the dispute and the relief you seek; we will try in good faith to resolve it within 60 days.
These Terms are governed by the laws of the jurisdiction in which the operator of Olen is established. If you are a consumer resident in the European Union, the United Kingdom, or another jurisdiction with mandatory consumer protection rules, you keep the benefit of those rules and may bring proceedings in your local courts.
To the extent permitted by law, disputes must be brought individually, and you and we each waive any right to participate in a class or representative action.
17. General Provisions
- Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us regarding Olen.
- Severability. An unenforceable provision is modified to the minimum extent necessary or severed; the rest stays in force.
- No waiver. Our failure to enforce a provision is not a waiver of it.
- Assignment. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
- Force majeure. Neither party is liable for failure to perform due to events beyond reasonable control.
- Notices. We may give notice in the App, by email, or by posting an updated document. Notices to us go to service@olen.cloud.
- Language. These Terms are written in English. Where a translation conflicts, the English version prevails.
18. Changes to These Terms
We may revise these Terms as the App evolves or as the law requires. We update the "Last Updated" date, and for material changes we give notice in the App and, where we hold a usable address, by email, normally at least 7 days before the change takes effect. Continued use after the effective date constitutes acceptance; if you do not accept, stop using the App and delete your account.
